  • Eligibility: Our services are available to individuals and businesses who can form legally binding contracts under applicable law.

2. Services Provided

Webtastix Web Designs specializes in web design, website maintenance, and related services. The specifics of each service will be outlined in a separate agreement or proposal shared with the client.

3. Payment Terms

  • Deposits: A 50% deposit is required upfront for all web design projects unless otherwise agreed upon.
  • Balance Payments: The remaining balance is due upon project completion, before the website goes live.
  • Late Payments: Delayed payments may result in a suspension of services until full payment is received.
  • Hourly Charges: Maintenance and updates are charged at R200 per hour unless stated otherwise.

4. Client Responsibilities

  • Content Submission: Clients are responsible for providing all required content (text, images, videos, etc.) within agreed timelines.
  • Approval: Clients are required to review and approve work at each milestone promptly. Delays in approval may affect project timelines.
  • Hosting and Domains: Clients are welcome to use their own hosting providers, but Webtastix Web Designs cannot be held responsible for third-party hosting issues.

5. Refund Policy

  • Deposits: Deposits are non-refundable.
  • Service Cancellations: In the event of a cancellation, any work completed will be billed accordingly.
  • Refunds: Refunds are only applicable in cases where no work has commenced.

6. Website Maintenance

  • Scope: Maintenance packages cover basic updates, security, and backups as agreed upon.
  • E-commerce Maintenance: Product updates, category changes, and WooCommerce-related updates are billed at R200 per hour.
  • Exclusions: Maintenance packages do not include redesigns or major structural changes unless explicitly agreed upon.

7. Ownership and Intellectual Property

  • Website Ownership: Upon full payment, ownership of the website is transferred to the client.
  • Content Ownership: Clients must ensure they have the legal rights to any content they provide for use on their website.
  • Third-Party Tools: Any third-party plugins or tools used remain the property of their respective owners and are subject to their licensing terms.

8. Limitation of Liability

Webtastix Web Designs is not responsible for:

  • Loss of data due to third-party hosting issues.
  • Downtime caused by external factors beyond our control.
  • Issues arising from unauthorized modifications to the website by the client or third parties.

9. Privacy Policy

Your privacy is important to us. Any personal information you provide will be handled according to our Privacy Policy.

10. Termination of Services

Webtastix Web Designs reserves the right to terminate services in cases of:

  • Non-payment.
  • Breach of these terms and conditions.
  • Misuse of our services.

11. Governing Law

These terms and conditions are governed by the laws of South Africa. Any disputes will be resolved in accordance with South African law.
